General Terms of Use
1. Your Agreement
1.1 The website www.splitdytravel.com and the Splitdytravel mobile app (together, referred to as the "Splitdytravel Platform") are operated by Splitdyboat (Hong Kong) Travel Limited, a company incorporated in Hong Kong. Before using the Splitdytravel Platform and the services provided by Splitdyboat (Hong Kong) Travel Limited, its affiliated entities (collectively, “Splitdytravel”), or third-party service providers (the “Operators”) via the Platform (the “Services”), please carefully review these Terms of Use (“Terms”). The terms “you” and “your” apply to both individuals accessing the Splitdytravel Platform and anyone for whom you make a booking or purchase through the Platform. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

2. Change of Terms of Use
2.1 Splitdytravel's Modifications
2.1.1 Splitdytravel reserves the right, at its sole discretion, to change or modify any part of these Terms of Use at any time without prior notice. You should visit this page periodically to review the current Terms of Use to which you are bound. If Splitdytravel changes or modifies these Terms of Use, Splitdytravel will post the changes to or modifications of these Terms of Use on this page and will indicate at the bottom of this page the date on which these Terms of Use were last revised.
2.1.2 Your continued use of the Splitdytravel Platform after any such changes or modifications constitutes your acceptance of the revised Terms of Use. If you do not agree to abide by the revised Terms of Use, do not use or access or continue to use or access the Splitdytravel Platform and/or the Services. It is your responsibility to regularly check the Splitdytravel Platform to ascertain if there are any changes to these Terms of Use and to review such changes.
2.1.3 In addition, when using the Services, you shall be subject to any additional terms applicable to such Services that may be posted on the page relating to such Services from time to time, the privacy policy (the "Privacy Policy") and the terms and conditions of Splitdytravel AI tools (the "Terms and Conditions of Splitdytravel AI Tools") adopted by Splitdytravel from time to time. All such terms are hereby expressly incorporated by reference in these Terms of Use.

3. Access and Use of the Services
3.1 Ownership of Content
3.1.1 The Splitdytravel Platform, including the domain name (www.splitdytravel.com), subdomains, features, contents, and application services (including but not limited to any mobile application services) offered periodically by Splitdytravel in connection therewith, are owned and operated by Splitdytravel.
3.2 Provision and Accessibility of Services
3.2.1 Subject to these Terms of Use, Splitdytravel may offer to provide the Services either by itself or on behalf of third-party Operators, as further detailed on the Splitdytravel Platform. The Services selected by you on the Splitdytravel Platform are solely for your personal use and not for the use or benefit of any third party. The term "Services" includes but is not limited to the use of the Splitdytravel Platform and any Services offered by Splitdytravel or on behalf of the Operators via the Platform. Splitdytravel reserves the right to change, suspend, or discontinue any Services at any time, including any feature, database, or content availability. Splitdytravel may also impose limits or conditions on certain Services or restrict your access to any part or all of the Services without prior notice or liability.
3.2.2 Splitdytravel does not guarantee that the Services will always be available or uninterrupted. Splitdytravel shall not be liable to you if the Services are unavailable at any time or for any duration. You are responsible for making all necessary arrangements to access the Services. You are also responsible for ensuring that any persons accessing the Services through your Internet connection are aware of these Terms of Use and comply with them.
3.2.3 If you link to the Splitdytravel Platform, Splitdytravel may revoke your rights to do so at any time at its sole discretion. Splitdytravel reserves the right to require prior written consent before any such linking.

4. Splitdytravel Platform and Content
4.1 Use of the Content
4.1.1 All materials displayed or provided on the Splitdytravel Platform, including but not limited to text, data, graphics, articles, photographs, images, illustrations, videos, audio, and other materials (“Content”), are protected by copyright and/or other intellectual property rights. The Splitdytravel Platform and its Content are intended solely for your personal and non-commercial use of the Services and may only be used in accordance with these Terms of Use. For the avoidance of doubt, any inputs into and outputs from Splitdytravel AI Tools do not constitute “Content”. For more information on Splitdytravel AI Tools, please refer to the Terms and Conditions of Splitdytravel AI Tools.
4.1.2 If Splitdytravel grants you access to the Splitdytravel Platform and/or the Content, such access shall be a non-exclusive, non-transferable, and limited license to access the Platform in accordance with these Terms of Use. Splitdytravel reserves the right, at its sole discretion and at any time, without prior notice, to amend, remove, or alter the presentation, substance, or functionality of any part or all of the Content on the Splitdytravel Platform.
4.1.3 You shall comply with all copyright notices, trademark rules, information, and restrictions contained in the Splitdytravel Platform and the Content accessed through it. You must not use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell, or otherwise exploit the Splitdytravel Platform, Content, third-party submissions, or other proprietary rights without the express prior written consent of the respective owners, or in any way that violates third-party rights.
4.2 Splitdytravel’s Liability for the Platform and Content
4.2.1 Splitdytravel does not guarantee the identity of other users you may interact with while using the Platform. Splitdytravel cannot guarantee the authenticity or accuracy of any content, materials, or information provided by other users or Operators. Access to and use of Content via the Splitdytravel Platform is at your own risk, and you will be solely responsible for any damages or losses arising therefrom.
4.2.2 Under no circumstances shall Splitdytravel be liable for any Content, including but not limited to errors or omissions, or any loss or damage incurred in connection with the use or exposure to Content posted, emailed, accessed, transmitted, or otherwise made available via the Platform.
4.3 Sort Order
4.3.1 Splitdytravel provides sorting and filtering options to customize search results based on criteria such as availability, price recommendations, popularity, reviews, or other factors. The Platform is continually optimized to improve user experience, and Splitdytravel may test different default sort algorithms.
4.3.2 Operators may participate in promotional programs involving increased commissions or commercial arrangements to enhance their search ranking or visibility on the Platform. Listings benefiting from such programs will be clearly marked as “Sponsored” or with similar labels.

5. Intellectual Property Rights
5.1 Ownership and Protection
5.1.1 All intellectual property rights related to the Splitdytravel Platform, including trademarks, copyrights, patents, and other proprietary rights, are owned by Splitdytravel or licensed to Splitdytravel for use on the Platform. The Splitdytravel Platform, Services, and all Content are safeguarded by copyright laws, international agreements, and intellectual property regulations as protected works and compilations.
You agree to the following restrictions:
(a) You will not alter, distribute, sell, create derivative works from, publicly perform, display, or otherwise commercially exploit any portion of the Splitdytravel Platform, Content, software, materials, or Services;
(b) You may only download or copy Content for your personal, non-commercial purposes, while preserving all copyright notices, trademarks, and proprietary markings; and
(c) You are prohibited from storing substantial portions of Content in any format. Any reproduction or storage beyond personal use requires explicit prior written approval from Splitdytravel or the respective rights holder indicated in the Content's copyright notice.

6. User-Generated Content
6.1 Posting and Sharing Information
6.1.1 When using the Splitdytravel Platform or Services, you may upload photos, reviews, comments, or other materials ("User Content") that could be visible to other users or used by Splitdytravel and its Operators to enhance the Services.
By submitting User Content, you grant Splitdytravel and Operators:
(a) A worldwide, royalty-free, perpetual, non-exclusive, transferable, and sublicensable license to use, modify, distribute, promote, and create derivative works from your User Content across all media channels for operating the Platform, delivering Services, and business purposes;
(b) Permission for Splitdytravel to process your personal information as outlined in our current Privacy Policy;
(c) A non-exclusive license to other Platform users to view, use, and interact with your User Content within the Platform's features, as permitted by these Terms;
(d) The right for Splitdytravel to edit, adapt, excerpt, translate, or reformat your User Content as needed. This license does not impact your ownership rights or ability to grant additional licenses to your content;
(e) You confirm and warrant that your User Content complies with all laws and does not violate any third-party rights, including copyrights or privacy; and
(f) You accept full responsibility for all User Content you post or share. Splitdytravel is not liable for any inaccuracies, errors, or issues in your submissions.

7. User Obligations and Commitments
7.1 Proper Use of the Platform and Services
7.1.1 You confirm and promise Splitdytravel that you will not submit User Content or use the Platform/Services in ways that:
(a) Violate copyrights, trademarks, privacy rights, or any other third-party intellectual property or personal rights;
(b) Break any local, national, or international laws and regulations;
(c) Include harmful, misleading, threatening, harassing, defamatory, obscene, or otherwise inappropriate material;
(d) Promote unauthorized commercial activities like contests, ads, or pyramid schemes without Splitdytravel's written approval;
(e) Impersonate others or spread false information about individuals or organizations; or
(f) Introduce viruses, malware, or other harmful code designed to damage systems.
7.2 Content Removal Rights
7.2.1 Splitdytravel may remove any User Content at any time, for any reason—including third-party complaints, suspected violations of these Terms, or to maintain Platform integrity—without prior notice.
7.3 Full Accountability for Your Content
7.3.1 You bear complete responsibility for everything you upload, post, or share via the Splitdytravel Platform.
7.3.2 You guarantee that:
(a) You own or have proper rights/permissions to use all elements in your User Content (images, text, etc.), allowing Splitdytravel to display and use it as intended; and
(b) Your Content and Splitdytravel's use of it will not infringe copyrights, trademarks, privacy rights, or violate any laws.
7.3.3 You agree not to:
(a) Engage in fraud, abuse, or illegal actions that could lead to account suspension;
(b) Resell bookings, tours, or services obtained through the Platform;
(c) Make speculative or fake reservations to hoard availability;
(d) Attempt to steal other users' login credentials or personal data;
(e) Hack networks, crack security, or distribute illegal/threatening content;
(f) Spam the Platform or overload its systems with automated processes;
(g) Use bots or scrapers to extract data from the Platform; or
(h) Reverse-engineer or attempt to access Splitdytravel's source code.
7.3.4 You are solely responsible for handling all taxes, duties, and government fees related to your Platform activities and transactions.

8. Account Registration and Security
8.1 Creating a Splitdytravel Account
8.1.1 To use certain features of our Services, you may need to open and maintain an account with Splitdytravel (“Splitdytravel Account”).
8.2 Providing Personal Information
8.2.1 As part of the registration process for some Services, you may be required to choose a username and password (“Splitdytravel User ID”). If you access our Services through a third-party platform, your Splitdytravel User ID may be required to match your username on that platform.
8.2.2 You agree to provide accurate, complete, and up-to-date information when registering. Failure to do so may result in immediate termination of your Splitdytravel Account in accordance with these Terms.
8.2.3 You warrant that you will not:
(a) Use another person’s name or identity as your User ID with intent to impersonate them; or
(b) Use a name protected by someone else’s rights without proper authorization.
8.2.4 Splitdytravel reserves the right to refuse or cancel any account registration at its sole discretion. You are responsible for keeping your password confidential and secure.

9. Reviews, Correspondence, and User Content Rights
9.1 When you complete a booking, you agree to receive confirmation notifications (via email, whatsapp and/or app) and invitations to provide feedback through guest reviews after your experience. Submitting a review is voluntary. Confirmation and review messages are transactional and separate from marketing materials. Reviews submitted may be published on the relevant experience page within 72 hours to help inform future customers. You may be awarded Splitdytravel credits (“SplitdyCredits”) for reviews subject to specific terms. Only one review per booked experience per month is permitted. Abuse or fraudulent reviews may lead to credit forfeiture, and Splitdytravel may deduct such credits without notice.
9.2 By submitting a review, you grant Splitdytravel a perpetual, worldwide, royalty-free, transferable, and irrevocable license to use, translate, edit, or remove your content as Splitdytravel sees fit.
9.3 You confirm that:
(a) You own or have lawful rights to share the content you post and authorize Splitdytravel to use it;
(b) The content is truthful and not misleading;
(c) Your posts comply with these Terms, applicable laws, and do not infringe others’ rights or harm any person or entity.
9.4 Reviews must not contain offensive language, hate speech, inappropriate or illegal content, personal information of others, or promotional material unrelated to the experience. Defamation, harassment, or violation of legal rights is prohibited.
9.5 Splitdytravel reserves the right to take legal action against individuals or entities violating copyright or these Terms. You accept full responsibility for your submitted content.
9.6 Content you submit is considered non-confidential. Splitdytravel may use, edit, reject, or remove content at its discretion without obligation to pay or notify you. Attribution is not guaranteed, and Splitdytravel is not obligated to enforce third-party attributions. See the platform’s Terms of Use for further details.

10. ORDERS
When you place an order, you are making an offer to purchase. SPLITDYBOAT (HONG KONG) TRAVEL LIMITED 香港山海城旅遊有限公司 and the opeartor reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until SPLITDYBOAT (HONG KONG) TRAVEL LIMITED 香港山海城旅遊有限公司 and the operator confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as SPLITDYBOAT (HONG KONG) TRAVEL LIMITED 香港山海城旅遊有限公司 and the opeator may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy [LINK].
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

11. Booking Confirmations, Tickets, Payments, and Refunds
11.1 Booking Confirmations
11.1.1 Some experiences offer instant confirmation, while others may take longer. Times shown on the Splitdytravel Platform are estimates only—actual confirmation depends on operator availability.
11.2 Purchasing and Redeeming Booking Vouchers
11.2.1 Through Splitdytravel, you can buy digital vouchers ("Vouchers") for tours and experiences offered by operators across Hong Kong destinations. After purchase, you'll receive an email with your Voucher code and details.
11.2.2 To redeem, arrive on time at the operator's designated meeting point with your Voucher code and any required ID. Late arrivals or missing documents mean no refunds.
11.2.3 Operators may ask for photo ID. Splitdytravel and operators are not responsible for lost, stolen, or damaged Vouchers. Vouchers become invalid if the activity is legally prohibited.
11.3 Voucher Conditions
11.3.1 Each Voucher has specific terms (age limits, validity dates, etc.) displayed at checkout. Vouchers are typically valid only for the stated date(s).
11.3.2 Unused Vouchers after the expiry date are non-refundable unless otherwise specified.
11.4 Cancellation Policy
11.4.1 Cancel within the time window shown at booking via Splitdytravel customer service. Eligible cancellations receive full refunds to your original payment method.
11.4.2 Operators make final decisions on Voucher acceptance. For service issues, contact the operator directly. All other fees are non-refundable. Prices are shown in the currency displayed before purchase.
11.4.3 If an operator cancels your booked experience, Splitdytravel will notify you promptly and process a full refund.
11.5 Assistance for Booking Issues
11.5.1 If you can't redeem a valid Voucher due to operator fault, contact operator@splitdytravel.com . We'll work with the operator to resolve the issue.
11.6 Service Fees
11.6.1 Splitdytravel may charge fees for certain Services as shown on the Platform. You agree to pay all listed amounts for your selected bookings.
11.7 Fee Changes
11.7.1 Splitdytravel may update fees with notice via email or Platform announcement. Continued use after notification means you accept the new rates.
11.8 Splitdytravel's Booking Rights
11.8.1 Splitdytravel reserves the right to cancel bookings violating these Terms at our discretion.
11.8.2 We aim to offer competitive pricing through operators, excluding taxes and additional fees.
11.8.3 While operators provide pricing data, Splitdytravel cannot guarantee complete accuracy at all times.
11.9 These terms apply to all Splitdytravel users worldwide.

12. Splitdytravel Referral Rewards Program
12.1 Program Overview
12.1.1 Splitdytravel occasionally offers members the opportunity to earn SplitdyCredits by inviting friends to join the Platform. Friends must complete their first confirmed booking through an official Splitdytravel invitation link (e.g., shared via the Platform, social media, or other approved channels) to qualify.
12.2 Program Rules
12.2.1 Rewards are only earned through official Splitdytravel invite links. Referrals outside these channels won't qualify. SplitdyCredits are non-transferable, cannot be sold, traded, or combined between accounts.
12.2.2 You'll receive credits only for your friend's first confirmed booking made via your official invite. If they don't properly follow the invite instructions, no credits will be awarded, and Splitdytravel isn't responsible.
12.2.3 Creating multiple accounts or trying to game the system violates these Terms and may result in account suspension and forfeiture of all earned credits.
12.2.4 You cannot run your own promotions or use Splitdytravel branding for marketing without written permission.
12.2.5 Splitdytravel may cancel rewards suspected of fraud, abuse, or violation of these Terms.
12.2.6 Eligible credits will be sent to your registered email within 24 hours after your friend's booking confirmation.
12.2.7 Splitdytravel may adjust credit values based on user activity at our discretion.
12.2.8 This program is void where prohibited by law. Splitdytravel can modify or end the program anytime. Any tax obligations are your responsibility. Account balances may occasionally show errors, but Splitdytravel isn't liable for discrepancies.

13.1.1 For details on how Splitdytravel collects, uses, and protects your personal information, please refer to our current Privacy Policy, which is incorporated into these Terms of Use by reference. By agreeing to these Terms, you also agree to the terms outlined in our Privacy Policy.

14. Liability Protection
14.1 Your Responsibility to Protect Splitdytravel
14.1.1 You agree to defend, indemnify, and hold harmless Splitdytravel, its parent companies, subsidiaries, affiliates, executives, directors, employees, and agents from all claims, damages, losses, liabilities, legal fees, and expenses arising from: your use of the Splitdytravel Platform, violation of these Terms, or any infringement of third-party intellectual property rights or other legal rights caused by you or anyone using your Splitdytravel account.
14.2 Splitdytravel's Role in Disputes
14.2.1 Splitdytravel may participate in defending against any claims or lawsuits related to your actions and assist in settlement negotiations. You cannot settle any matter that affects Splitdytravel's rights without our prior written consent. Splitdytravel reserves the right, at our expense and after notifying you, to take full control of the defense against such claims.

15. No Warranties and Liability Limits
15.1 No Special Relationship
15.1.1 Splitdytravel has no special obligations or fiduciary duties toward you regarding Platform use or Content. You recognize that Splitdytravel cannot control: (a) who accesses the Platform; (b) what Content you view; (c) how Content affects you; (d) your interpretation of Content; or (e) actions you take based on Content.
15.2 Operator Services and Recommendations
15.2.1 Operators list their Services on our Platform, and users may share suggestions. Splitdytravel makes no guarantees about the accuracy of Service descriptions, recommendations, or user feedback.
15.3 Liability Exclusions
15.3.1 Splitdytravel, the Platform, and our affiliates, executives, directors, and employees will not be liable for indirect, consequential, special, incidental, or punitive damages from: (a) Platform use; (b) these Terms violations; (c) your or third-party misuse; (d) Services or tools provided; or (e) user interactions—even if warned of potential risks.
15.3.2 These limits apply regardless of legal basis (contract, warranty, strict liability, tort, negligence, etc.), to the maximum extent allowed by law.
15.3.3 The Platform and all Content, software, features, and information are provided "as is" without warranties—express or implied—including merchantability, fitness for purpose, non-infringement, uninterrupted service, or security of data transmission.
15.3.4 Communications via the Platform are not private and may be intercepted. Posting Content doesn't create any confidential relationship beyond these Terms.
15.3.5 Splitdytravel isn't responsible for Operator or third-party Content accuracy, safety, or transactions. We don't participate in or guarantee Service fulfillment.
15.4 Your Only Remedy
15.4.1 If dissatisfied with the Platform, Terms, or disputes with Splitdytravel/other users, your sole remedy is to stop using the Platform.
15.4.2 Splitdytravel's maximum liability to you or third parties is limited to the greater of: (a) fees you paid us in the prior 12 months; or (b) HKD 500 total across all claims.

16. Third-Party Interactions
16.1 External Links and Services
16.1.1 The Splitdytravel Platform may include links to external websites or services ("Third-Party Sites") not owned or controlled by Splitdytravel. Accessing Services through third-party logins doesn't imply endorsement of those sites or their content, products, or promotions.
16.1.2 Using Third-Party Sites is at your own risk. You agree to follow their terms and policies, in addition to our Terms of Use.
16.1.3 Splitdytravel has no control over Third-Party Sites' content, accuracy, privacy practices, or opinions. We don't monitor, verify, or edit external content. You release Splitdytravel from all liability related to your use of Third-Party Sites.
16.1.4 All dealings with operators, payments, service delivery, and related terms are directly between you and those third parties.
16.1.5 Conduct your own due diligence before engaging in any transactions with external parties.
16.2 Splitdytravel's Non-Involvement
16.2.1 Splitdytravel isn't responsible for losses from third-party dealings. We have no obligation to mediate disputes between users or with external parties.
16.2.2 In case of conflicts with other users or third parties, you release Splitdytravel, its affiliates, executives, employees, agents, and successors from all claims, damages (direct or indirect), known or unknown, related to those disputes.

17. Payment
17.1 Payment Handling
17.1.1 To provide efficient support for refunds and cancellations (where applicable), all payments for bookings made through Splitdytravel will be processed through Splitdyboat (Hong Kong) Travel Limited’s designated bank account at Hang Seng Bank (Account Number: 370738577883).
17.1.2 Regardless of the payment method you select on the booking platform (e.g., credit card, bank transfer), all funds will be directed to this bank account to ensure centralized and secure payment handling.
17.2 Payment Methods and Processing
17.2.1 Currently, Splitdytravel accepts payments via credit card and bank transfers. When you choose your preferred payment method during booking, the payment amount will be collected and settled into the designated bank account.
17.2.2 If you opt to pay by credit card, the payment transaction will be securely processed via our payment gateway, and funds will be deposited to the Splitdyboat bank account mentioned above.
17.2.3 Splitdytravel does not charge extra fees beyond what is displayed at checkout. However, your bank or card issuer may impose additional fees such as currency conversion or international transaction fees, which are your responsibility.
17.3 Currency and Payment Amount
17.3.1 Prices are shown in the currency specified on the booking platform. Payments made in other currencies will be converted through your bank or card issuer’s exchange rates.
17.3.2 Splitdytravel is not responsible for fluctuations in exchange rates or additional fees charged by your bank or payment provider.

18. Account Termination
18.1 Splitdytravel's Termination Rights
18.1.1 These Terms remain active while you use our Platform or Services. Splitdytravel may suspend or terminate your account access anytime, for any reason, without notice, which could result in loss of all associated data. We may also immediately halt Services or Platform access if you violate these Terms.
18.2 Termination Consequences
18.2.1 Upon termination, your rights to use Services, access the Platform, or view Content end immediately. Provisions meant to survive (ownership rights, liability limits, disclaimers) continue to apply.
18.2.2 If terminated due to your breach, Splitdytravel may cancel any active Vouchers without refund.

19. Travel Documents and Requirements
19.1 Your Obligations
19.1.1 All travelers must verify entry requirements with destination country consulates regardless of nationality.
19.1.2 Visa and health rules change without notice—check with relevant authorities before travel.
19.1.3 Some operators require specific documents, licenses, or local compliance for participation.
19.1.4 Splitdytravel strongly recommends comprehensive travel insurance before departure.

20. Applicable Law
20.1 These Terms are governed by Hong Kong SAR laws. You submit to Hong Kong courts' non-exclusive jurisdiction.

21. General Provisions
21.1 Severability
21.1.1 If any Term provision is invalid, it will be limited only as needed to keep the rest fully enforceable.
21.2 Transfer Rights
21.2.1 You cannot assign these Terms without Splitdytravel's written approval. Splitdytravel may transfer them anytime without notice.
21.3 Language
21.3.1 These Terms are written in English. Translations are for convenience only. English prevails in conflicts.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

23. OUR PRODUCTS
We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration.
We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations or be the same as depicted or rendered in our online stores.
All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.
